Welcome to FitGPT. By downloading, installing, or using the FitGPT mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

FitGPT is a nutrition tracking application that uses artificial intelligence to help you log meals and monitor your calorie and macronutrient intake. The App provides nutrition estimates based on restaurant data, public food databases, and AI analysis.

2. Eligibility

You must be at least 13 years old to use FitGPT. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.

3. Account Registration

To use FitGPT, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Create multiple accounts for abusive purposes.
• Scrape, harvest, or collect data from the App by automated means.

5. Nutrition Information Disclaimer

FitGPT provides nutrition information for informational purposes only. While we strive for accuracy using official restaurant data and verified databases, nutrition values are estimates and may vary based on preparation methods, portion sizes, and regional differences. FitGPT is not a substitute for professional dietary, medical, or nutritional advice. Always consult a qualified healthcare professional before making significant changes to your diet.

6. Subscriptions and Payments

FitGPT may offer free and premium subscription tiers. If you subscribe to a paid plan, payment will be processed through Apple's App Store. Subscription terms, pricing, and renewal policies are governed by Apple's terms. You may manage or cancel your subscription through your Apple ID account settings.

7. Intellectual Property

All content, features, and functionality of FitGPT — including but not limited to text, graphics, logos, icons, software, and the compilation thereof — are the property of FitGPT and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our express written permission.

8. User Content

You retain ownership of the nutrition data and food entries you create in FitGPT. By using the App, you grant us a limited license to process your food entries through our AI systems for the sole purpose of providing nutrition analysis back to you. We do not use your personal food data for any other purpose.

9. Limitation of Liability

To the maximum extent permitted by law, FitGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, but is not limited to, damages arising from reliance on any nutrition information provided by the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from within the App or by contacting support@fitgpt.fit. Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
